What Happens When You Get a DUI in Colorado?
In Colorado, you can be charged with DUI if you are driving with a blood alcohol concentration (BAC) of 0.08% or higher. You can also be charged with DUI if you are driving under the influence of drugs or a combination of drugs and alcohol.
If you are pulled over by the police and they suspect that you are driving under the influence, they will likely ask you to take a series of field sobriety tests. These tests are designed to assess your mental and physical impairment.
Common field sobriety tests include:
- Horizontal gaze nystagmus
- One-leg stand
- Walk-and-turn
If the police officer believes that you are driving under the influence, they will arrest you and ask you to submit to a chemical test to measure your BAC.
There are several types of chemical tests, including:
- Blood test
- Breath test
- Urine test (in the case of suspected drug use)
You have the right to refuse to take a chemical test, but if you do, your driver's license will be automatically suspended for 1 year.
If you are charged with DUI, you will be required to appear in court for an arraignment. At your arraignment, you will be asked to enter a plea. If you plead guilty, the judge will sentence you right away. If you plead not guilty, your case will go to trial.
At your trial, the prosecution will try to prove that:
- You were driving under the influence
- The police officer had probable cause to pull you over
If the prosecution is successful, you will be convicted of DUI. If the prosecution cannot prove all of the elements of the crime, you will be acquitted.
Penalties for DUI in Colorado
Colorado has some of the strictest DUI laws in the country. Even first-time offenders face harsh penalties that could impact their lives for years to come.
Penalties for a first-time DUI conviction in Colorado include:
- Up to 1 year in jail
- Up to $1,000 in fines
- Up to 96 hours of community service
- Up to 2 years of probation
- 12 points on your driving record
- Driver's license suspension for 9 months
The penalties for a second, third, or subsequent DUI conviction are even more severe.
How Can a DUI Be Dropped?
There are many defense strategies that can be used to fight DUI charges. For example, if the police officer did not have probable cause to pull you over or violated your rights during the traffic stop, we may be able to get the evidence against you thrown out.
Other possible defenses include:
- The breathalyzer equipment was not properly calibrated
- The breathalyzer test was not administered correctly
- You were not the one driving the car
When you hire us to represent you, we will conduct a thorough investigation and review all of the evidence against you to identify any weaknesses in the prosecution's case.
